Harlan's grasp safe with Dave Shaeffer's suspension

    You know the ATA official rules as well if not better than I do. Do you see any breach of the official ATA Rules and/or By-laws in the complaint proceeding(s) against Mr. Shaeffer? As you know unless the complaint alleges a serious breach of safety to warrant an immediate administrative suspension, the complaint upon completion of the investigation and review by the Zone VP is scheduled for adjudication at the next meeting of the EC, which in this instance was 08/01/17. I believe that there may have been instances over the years where a special meeting/teleconference of the EC was called. However, if I recall correctly those instances had to do with a reconsideration of the suspension or an appeals proceeding. I may be wrong but I don't recall any instance where the EC called for a special meeting solely for he purposes of adjudicating the "common" (for lack of a better word) complaint. I never stated that he was told/informed of the final disposition on 08/01/17. Although, I don't know of any provision/restriction which would prohibit any of the VP's telling him of the final disposition prior to the date of it becoming effective. However, in accordance with the ATA By-Laws, a copy of the charges/violations must be mailed to the accused/member at least (10) days prior to an action being taken by the EC. Hence, as stated in the "Suspension Letter" posted by Merlo, the effective date of suspension was 08/15/17. Hypothetically they could have suspended him effective 08/12/17 if they really wanted to stick it to him.

    Why wouldn't Mr. Shaeffer want to attend the Grand? Admittedly it is not as "glorious" as it once was but it is still the largest tournament of the year, offering significant purses, especially for a shooter as accomplished as Mr. Shaeffer. Not to mention that he is more than capable of adding another championship ring to his collection which I would think would hold a much high priority than and any AA team/points. If this entire matter was some sort of predetermined collusion, set-up or lynch job by the ATA Officials to protect a certain poster boy and/or secret agenda as some have suggested why even take the chance of allowing Mr. Shaeffer attend the Grand. If this was such a corrupt proceeding, given that he was accused of safety violations, why not suspend immediately? How would it have looked to the general membership if Mr. Shaeffer had won the Clay Target Championship or better yet The Grand American Handicap only to be suspended three days later?

    Regarding Bat's question about a what constitutes a "member in good standing". The ATA Officials Rules are not very specific as to definition of what constitutes "good standing". Section I, C references "good standing" as one who is current with all required dues and fees (State/Provincial). Section XII, C.2 refers to any member who is suspended as being barred from participating in ATA activities for the period of the suspension. The general accepted legal definition of a member in good standing states in part, "a member who has fulfilled the requirements of membership (dues/fees) and has neither voluntarily withdrawn membership nor has been expelled or suspended from membership." In my opinion Mr. Shaeffer could make a legitimate argument to have his AA points reinstated. Perhaps a better option would have been to list Mr.Shaeffer with is AA point totals noting that he was ineligible for AA team consideration due to the suspension.

He was not only supposed to be "unsafe", he was supposed to beat a 100 pound woman's ass in the "parking lot" ..... so "immediately" would sound appropriate ....

    What if "immediately" would have stopped Mr Shaeffer from earning ANY All American Points at the "Grand", that some knew on "08/01/17" could not "count" for anything ..... and those available "points" could have changed the "All American status" for one or more OTHER shooters who spent their time and money, and did no "wrong" ?????

    If the charges are accurate (or not ) based on the way this suspension was done David could of attended the grand next year (2018) and have targets and AA points taken away from the date it happened (before the grand 2017) and before like they are doing to him now ... If nothing else, this part of it appears to make it a set up, extreme and uncalled for and not justifiable in any way ... WPT ... (YAC) ...

    Should rubber mats be mandatory to keep from distracting the shooters when you twang the barrel to pop out a shell? Cant have marks on the cement. Or should the mats be banned to keep shooters from trying the twang thing?

    If Mr. Shaeffer has been declared by the ATA as having a safety violation then isn't it up to the clubs to decide individually to allow him on their property. Any safety violation resulting in a possible 2 year suspension would raise my eyebrows if I was the insurer. And what if the violation was untrue? Wouldn't that add to damages?

    It is very frustrating to the shooter when shells get hung up in the gun, any one who has shot for any length of time has had this happen so even though rare it does happen ... Seasoned trap shooters know the feeling and unless they are having a less than stellar day they would probably offer assistance in the way of offering the person a wad knocker to use until they finish the round (personally, I have done this on many occasions) or someone (anyone) ask the referee/puller to get a rod ... The ATA at one time recommended (think it was a rule ) clubs have doll rods ( 3/8 - 1/2) at each trap field just in case a problem would arise so the shooter in question could use the rod to push the shell out of the gun ...

    Have to see how this all plays out in the end but the specifics do not seem reasonable or justifiable to a lot of people ... I cannot see any place in the rule book where a shell sticking in a gun is considered to be a safety infraction so that pretty much eliminates something that could and or should warrant a suspension depending on the circumstances ... Getting the ATA involved in something of this nature seems to be extreme and not logical ... WPT ... (YAC) ...

    I think it all boils down to someone had an axe to grind. Or someone ran her mouth when she should have waited for a better time to discuss her irritation. Why anyone would start a confrontation at a gun club is beyond comprehension. Especially when you are at a 150 lb. disadvantage. Maybe she is related to bill's first wife, and also has a 150 lb. mouth.

    The Question, why would anyone shoot their mouth off at a gun club right after shooting, because she knew she could and get away with it. Just my opinion.

    All you have to do is read the posts and you will know when she accosted him. We do not know what was said in the parking lot, where he was followed after leaving the field. It is not good practice to poke anyone with a sharp stick when they are having a bad day, especially at an event where every one has a gun, do you agree? The people on the squad handled this poorly, David handled this poorly, the EC handled this extremely poorly, but that is common on their part. Everyone handled it poorly, but David is the only one paying a price for all of the actions. Roger C.

    I have received some info about the problem, that we have been discussing for the last couple of weeks. Most of what we have seen on here is not what happened. There was no confrontation by three persons in the parking lot. This has been blown out of proportion as to what transpired on the field. I think we should cease making judgements on what has been posted. Lets all take a deep breath step back and wait until the ATA gives out the reason for the complaint.
    If we find that Sandy is owed an apology,and it looks like we should, it very well should be forth coming by all concerned. Roger Coveleskie

    Who has ever saw any shell hang up in a Silver Seitz? His gun was throwing shells every time it opened, the typical 5 ft a Seitz throws them. Better yet “experienced shooters” are believing this crap. He’s making stuff up so he doesn’t look that bad.

    He was also shooting gold medals a premium shell that “sticks” in the gun, come on.

    Those that were there know what happened the rest have nothing better to do now and like to speculate and debate.

    If the ATA had been forth coming with the info about this complaint, non of this would have transpired. They act like a secret society, they let this speculation get out of hand, and the posters also jumped to conclusions because of their lack of trust in the EC and ATA leaders. Sandy is owed a sincere apology and when I meet her at the Spring Grand, I will do so. Roger Coveleskie

    If Shaeffer threatened someone at the line I am assuming he had a gun nearby. The question then is........

    Why didn't this guy get a lifetime ban?

    If threatening someone in the proximity of guns does not get you a lifetime ban then someone please explain what does. Cheating-no. Already had targetgate. Easy targets were thrown for years by many club managers. How many lifetime bans?

    If Shaeffer was repeatedly doing things that were dangerous, other than threats, then again.....

    Why didn't this guy get a lifetime ban?

    This happened in PA. What is the definition of reckless endangerment in PA?

    Title 18, Section 2705 of Pennsylvania Statutes defines reckless endangerment as a person recklessly, meaning without caring about consequences, doing any act that puts any other person in danger of death or serious injury. It's under the assault section of Pennsylvania code.

    I wasn't there but as I read the minutes I wonder if this should have been reported to the police. Certainly the EC would report a crime?

    Hey "Huntin" I'm just jumping in here with some information. I've been shooting Silver Seitz for more than 20 years. Shells do get stuck in them. I still remember the first time. Shooting the MD Handicap Championship in Thurmont before the move to Millington. I think stuck shells are more of a problem with guns that have high mileage on them. It has never been a problem for me as I'm on my fourth SS. My wife is shooting her second SS and her gun has a problem with some Federal shell. It might be Top Guns can't remember and she's not here to ask. BTW, DS was having stuck shells with the new Federal Grands in FL last year.

    10-4. A stuck shell in a SS is not a common occurrence. I have probably had < 5 in the past 20 years.

    I have heard a lot of those that attend have to attend to get the ATA points or are mandated by a vendor they represent. Part of being a pro I guess.

    Actually I don't know. You were the witness?n Was there a gun being used in an unsafe manner without regard to other people's safety? Isn't that a big part of the complaint?

    And you also said "Dave threatened her". Did he have a gun in his hand at the time? Those are your words. Threats are illegal in PA?

    Someone implied the subject was "trembling".

    Did you report this to the police? You were a witness?

    Hunting Fool gave a very Biased (opinion) narrative of what he witnessed according to an earlier posting by him, according to him David was totally in the wrong, caused the entire problem and voiced a threat about going to the parking lot beside not getting a bad enough penalty handed down for his actions ... The weight comparing was like a fight card comparing one persons statistics to the other, weight and difference in arms reach ... I think she might of been able to take him if given the chance ... WPT ... (YAC) ...

    I have scoured the rule book and do not, and cannot find what David did listed as an unsafe practice, did I miss something ..?

    I have no reason to doubt HF. He may be describing what may be a crime. Again I was not there. He was. If he is or was law enforcement then I have more questions. He isn't answering.

    This was handled by the PSSA in the manner they felt fit, all of the what if’s and everything else are irrelevant. It’s clearly winter time and everyone here has nothing better to do.

    The PSSA had all of the information they needed and made a decision based upon that, it’s private property and they can do what they want by telling someone they are or are not welcome there.

    You didn't like me implying you might have had an obligation if you are or were law enforcement. You did state the following on post #293.

    That being said my account of the incident and threatening is as follows:
    Then you accused me of elevating this to a crime. I didn't see it. You did.

    And then you described the threat.

    David said to Sandy “Give me 10 minutes and we can settle this in the parking lot.” that might not be the exact words as it’s been 6 plus months ago. Your talking about a 350ish pound man speaking to a female who is maybe 100 lbs. Sandy was upset because this behavior went on and she was physically shaking. My personal interpretation of that is “I’ll kick your a$$ in the parking lot in 10 minutes.”

    Huntin'Fool - You said it was a threat.? You implied she felt threatened? You implied you are or were in law enforcement and you testified to the above? And you did not notify any authorities? Just watched? And now you are taking the 5th?

    I am not an expert. Huntin'Fool said this was a threat. Why should I doubt him? I have only quoted him. I have not given my interpretation. But, if I were to believe HF, the young lady was a victim. My question only his to HF is why he did not report this? I am not even questioning the ATA?

    If you "witnessed" someone shoot all 100 targets to say this as a fact ..... "I witnessed him shoot and there were no ejection issues." .....

    The question becomes ..... Was the "safety violation" and the "threat" 'one and the same' ?????

    If so ..... then the "point" KS33 is trying to make is valid ..... the person should have been "reported" to "law enforcement" on the spot .....

    I have seen lighter sentences for more gregarious actions. I do not think it was only based on that days performance, some of the annamosity was a carry over. In all fairness to Sandy, what I was privy to, David was over the line. Roger C.

    There are many things a "ATA hater" like me call "a big deal" ..... with "PULL2012" being the top of the list, but just a 'drop in the bucket' .....

    The Kool Aid Crew will keep the "ATA" in a accelerating death spiral ..... and THAT IS NO "BIG DEAL" .....

    I can. One of my friends got 5 years just for putting a line judge against the wall at Vandalia for not doing his job. The big overgrown baby huey shed a few tears and called security and my buddy got himself escorted off the grounds.

    This is a crazy - assed thread. At first I thought there was a conspiracy against Shaeffer guy. There is the hanky lanky stuff? Whatever that is. Then I changed and thought this lady was the provoker but those accusing her of that changed their story. Then the witness came in. Pointed the finger at what sounded like criminal activity. And then someone seems to have accused that guy/witness of being a cop or something. And then the cop guy backed off his statements. Now he didn't witness much.

    I cant make my mind up now. I cant see how anyone in the EC camp came up with anything other than a shame on you warning but I am waiting for another chapter.

    Sure seems to me that Mr. Schaffer was actually given more privilege than others, maybe because of his status. Prior incidences, and behavior should have resulted in the two year suspension instead of him being able to diminish punishment with a simple apology.

    #16-01 Against Mr. Eric M. Flexer (#12-159290) as filed by Mr. Skip Klinger (#44-24775)- Mr. 171 Klinger alleges that Mr. Flexer verbally abused at least one score keeper and the line supervisor 172 at the Pennsylvania State Sportsmen’s Association ATA registered competition on September 173 13, 2015 in violation of Section XII,B.,1., of the Official ATA Rules. The behavior is alleged to 174 have taken place over three separate sub-events and did not appear to be merely an 175 undirected slip of the tongue. Witness testimony indicated that there was no question as to 176 the type of language that was used. President Morris (Eastern Zone) recommended that Mr. 177 Flexer be suspended for a period of two years from the date of notification. The Executive 7 178 committee was in unanimous agreement. Mr. Flexer was notified via registered letter on 179 October 23, 2015.

    #17-03 – Against Mr. David Shaeffer, Jr (#90-01762) as filed by Mr. Skip Klinger (#44-24775) – 169 Mr. Klinger alleges that Mr. Shaeffer violated Section XII, B., 1., a.; Section XII, B., 2., b. and 170 Section XII ,B., 2., c. of the Official ATA Rules on June 18, 2017 while competing at the 171 Pennsylvania State Trapshooting Championships (PA State Shotgunning Association, Elysburg, 172 PA). All allegations are of unsportsmanlike and unsafe behavior. Since the complaint was filed 173 by the state Delegate, investigation by same would represent a conflict of interest. Therefore, 174 the investigation was assigned to the Alternate by certified mail on June 20, 2017. The 175 investigation was complete on July 11 and the results and recommendation were forwarded to 176 the Vice President. The Vice President recommended a letter of apology be issued by Shaeffer 177 to each of the complainants within 30 days of receipt of the notification to him of the decision 178 or face a two (2) year suspension. The recommendation was not met with majority support by 179 the remainder of the Executive Committee. In accordance with ATA rules and by-laws, the 180 President made recommendation to the Executive Committee that Mr. Shaeffer be suspended 181 for one full year from date of notification, with the stipulation that an additional year will be 182 added to the suspension if letters of apology are not sent to the complainants with copies to 183 the ATA Executive Director within 30 days of date of notification. This recommendation 184 received majority support. (Secretarial Note: Shaeffer was notified via certified letter on 185 August 13 of the decision and copies of apology letters were received in Sparta on September 186 13.     As per my conversation with the late PA delegate who recommended the two year suspension for Mr. Flexer I will quote "I recommended a two year suspension for Mr. Flexer with the belief that the powers at the ATA would not honor my suggestion and issue a one year suspension only, I was wrong".

    I read the statemement in Shaeffer's suspension to mean what it said. "One year will be added". No where does it say the suspension time could be diminished. Where did you see "diminished"?

    First it was a 350 pound Giant (typical trap shooter) taking a 100 pound midget (not so typical trap shooter) to the parking lot for getting upset that his shells would not eject and he was disturbing the rest of the squad by thumping his gun barrel on the rubber pads at each post ... Then it was a Delegate that filed the charges but had to have the alternate Delegate do the investigation because it would of been a conflict of interest if he done the investigation of charges he filed against another shooter on behalf of the members of a squad full of other shooters ... Then they wonder why people quit faster than they can be replaced ... Who's on FIRST , ..? WPT ... (YAC) ...

    No one is quitting due to this. If anything it might have renewed some interest. Possible tag team matches / gun throwing contests can only help PA attendance.

    Generally an armed society is a polite society. What 100 pounder shows up in a parking lot in armed. If I were the 350 pounder I might worry what was in the pockets.

    The problem with most ( not all ) people is even if they have a gun they are afraid or do not have the stones it takes to use it to take a mans life ... I had a guy pull a gun on me, rack a round into the chamber and foolishly put it away as I was telling him he didn't have the balls to kill a man and a few other choice words ... While all this was happening I got my Glock in my hand so when he walked up to my window (surprise) he did not have a chance to get his out again or have any desire to as he was looking down the barrel with it was right in his face ... I should of called the Police and had him arrested for brandishing a weapon (felony) but was only glad to have control of the situation ... I took his gun out of his waist band took the ammo out of the magazine threw it on the ground then proceeded to throw his gun and magazine as far as these old arms could throw them ... The pieces were flying every where and he said Sir so many times I got tired of hearing it ... I warmed him that if he ever see's this face again being as I will remember his he is probably going to die if he pulls that stupid stunt again ... My wife says I am getting to old for this crap, but not ready to die just yet ... WPT ... (YAC) ...

    I have read the posts where Shaeffer was claiming to have shells getting stuck in his gun. I was not there but.......does he have the possibility of a claim against the shell manufacturer? Just wondering.

    This guy got railroaded. The guys at the top are breathing a bit easier. Shaeffer was becoming the star. Maybe an unwelcome star but still he was making the big shots with the big sponsors look not so big. Let this be a lesson.

    I don't think anyone ever questioned the fact of her being a nice lady beside being easy on the eyes ...     I am wondering which definition of martyr fits her state of mind. I wonder if the definition has evolved from time of occurrence/incident to the present.

    I am not sure how a “witness” on the immediately following squad could possibly observe the ejection, or failure to eject, of 100 shells in the squad ahead. As a Silver Seitz owner; I can state some hulls will stick in some barrels. I have one brand’s promo load hulls causing trouble in a virtually new k80. There are other promo load hulls I have not used. They may give good or bad results in either of the guns I use at present.

    Now that I think about it I have decided.

    IF SHAEFFER ISN'T SHOOTING I'M NOT SHOOTING.

    I might shoot when they have the Championship Series Shoot. If the ATA will send me a letter of apology I may shoot sooner.

    The PA shoot is close. Will Mr. Shaeffer be permitted on the grounds or is he just not permitted to shoot? Are there any events in his name this year? They had a doubles shoot in his honor at the Buckeye. I don't think he won it this year.

    There were many invitations to not shoot at a certain facility back when it was about to open, funny thing they have never been able to draw a crowd and now its all of those who will not shoot there who's at fault because they will not support the Association ... Choose ones words cautiously "Grass Hopper", you might get what you wish for and they might end up missing him more than you think ... WPT ... (YAC) ...
