IDNR NO ABATEMENT - Send rent!

    have received copies of a few of these notices. It looks like this year’s rent that was not used will not be applied to next year. A legal scholar would be helpful.

    Some vendors paid for rent for the Grand at two venues.

    Thanks to you guys getting this to my desk.

    Begs to question why would it? If you sign a lease and leave your still on the hook for the remaining time left on the lease. Also it could be said if the State doesn’t let you use the facility and it’s not your (ATAs) fault the rent should be refunded or applied to later dates, I say the State uses this against the ATA in any way that benefits Illinois. Make bad choices and nothing good can come from it. Maybe the ATA will add a $1 fee to help pay for this like the horse barn full of Tarnished trophy’s nobody is seeing!

    It would be interesting to see the leases and how they word it in such a way as you do not get to use the leased property but you still have to pay for it in this kind of circumstance ... The lease is for the duration of the shoots not for the duration of the building being there ... There should be an escape clause that works for and or against both parties to actually be legal, but we are talking the State of Illinois here ... Have to wonder if the ATA took over the leases with the vendors as well as the camping areas ... This is no doubt going to PISS a bunch of people off, and rightfully so ... WPT ... (YAC) ...

    Services rendered, no service rendered why would the Vendors or Campers have to pay ..? There would have to be a stipulation in the lease I would imagine ...

    Who would have guessed it Illinois screwing gun owners, gun manufactures, or Gun Shooting organization.. Why didn't someone say something about this before?

    Talk about screwing gun owners George Soro's bought Marlin Fire Arms just so he can close it down ... Not sure if it is a done deal yet but has been in the news as of late ... WPT ... (YAC) ...

    Yep, I am old and don't understand a lot of things any more.

    IF the State of Illinois closed the place, and won't allow anyone in, how can they demand that the vendors still pay rent ?

    Yes indeed, I'm confused.

    On the issue of rent payments I find it curious that vendors would sign a contract that did not include a (Force Majeure” aka “the Act of God” clause).

    It is also curious that the term "abatement" is used. Was there previous discussion of a reduction in rent discussed? Covid 19 has caused quite a stir among landlords & tenants concerning rent payments and lost revenues on both sides.

    wpt, what is sad is venture capital buying respected companies and making a mess of them. I read somewhere (can't substantiate) that the past decade and half have been very good for gun companies in America (think Ruger, Sig, S&W) and yet Big Green is heading into Chapter 11. Sure seems that seldom does an industry roll up (think banking, health care, etc) end up benefiting the customer.

    If someone could find and post a copy of the lease vendors sign - that would be informative as to the ops post from the IDNR concerning rent abatement.

    This is from an older WSRC lease but I would assume it remains in all the current leases.

    Merlo, whats the date on the rent request? Before or after IDNR pulling the plug?

    HistoryBuff, thanks for the copy - is this (10.2) a component of a building vendor lease or for the ATA lease as the Lessee?

    10.2 deals only with GA funding - there must be more sections dealing with other failures to perform clauses.

    10.2 was from an old building vendor lease that expired in 2017. Vendor leases, it appears, fail to contain safeguards for legislative or judicial action.

    Some years back, (circa 2015), I believe the ATA informed vendors that utilizing the annual payment to the IDNR decreased their liability losses to one year should WSRC close their doors or limit activity. They had the right to either terminate their lease but there would be no refunds from the State of Illinois.

    The ATA wisely addressed this subject in their lease with the IDNR.

    I thought some might be interested in reviewing an actual lease.

    Below is an expired lease from one of the vendors who I believe is still operating a business at the WSRC.


    If existing vendor leases contain the provisions contained in this initial building lease, it would appear that Ms. Gunterman of the IDNR's Concession & Lease Division is acknowledging that the the State of Illinois has no intention to live up to what they agreed upon.

    Relevant provisions to this discussion are found in 8.4; 10.1 & 10.2

    Wow, HistoryBuff, impressive record keeping/researching on your part!

    10.5 Force Majeure: I think this clause gives the Lessee (vendor) strong grounds to argue no rent payment will be forthcoming and if paid upfront preferably funds returned or at the very least applied to a future year.

    Thank you Jammer.

    I'm only one of many people trying to stay informed (using verified documents) on all aspects of our sport. I think its because we care so much.

    Of course, we are aware of the risk that some will label us as "haters" and "bashers" for merely attempting to oversee the decisions of management in both the ATA and IDNR.

    Call me what you like, but I'll usually provide documentation in support of my comments, unlike those simply choosing to name-call.
